GENERAL TERMS AND CONDITIONS

1. Acceptance of Terms
These Terms and Conditions govern the use of the services provided by CSPOR RENTALS (smart holidays®).
By using the website www.smartholidays.com or making a booking, the Customer declares that they have read, understood, and accepted these Terms.
2. Changes to the Terms
smart holidays® may update these Terms whenever necessary.
The most recent version will always be available on the website. Continued use of the service implies acceptance of any changes.
3. Copyright and Intellectual Property
All content on the website belongs to CSPOR RENTALS or authorised third parties.
The use, reproduction, or distribution for commercial purposes without prior written authorisation is prohibited.
4. Customer Registration
To make bookings, the Customer must provide:
- Full name
- Date of birth
- Telephone contact
- Nationality
For invoicing purposes:
- Name
- Address
- Tax number
Additional data may be requested to comply with legal obligations.
5. Bookings
The booking is sent by email and is only considered confirmed after the initial payment has been made.
6. Payments
Prepayment may be made by:
- Bank transfer
- Credit/debit card
The remaining balance must be paid at check-in, in cash.
Cheques or any other payment methods are not accepted.
7. Cancellations
Cancellation conditions are presented before booking confirmation.
Standard Booking
- Up to 60 days before the check-in date: loss of deposit
- Less than 60 days or no-show: the Customer is responsible for full payment of the booking
Non-Refundable Booking
- No refunds under any circumstances
8. No Show
If the Customer fails to arrive by 12:00 on the day following the scheduled check-in date, without prior written notice, the booking will be cancelled without refund.
9. Security Deposit
A security deposit (minimum €300) will be required and refunded up to 7 days after check-out, following inspection of the property.
Deductions may be made for:
- Damages
- Additional cleaning
- Losses
- Excess number of guests
- Misuse of the property
10. Booking Changes
Changes may be made up to 60 days before the check-in date, subject to availability.
Administrative fee: €100
This fee also applies if the number of booked nights is reduced.
11. Changes or Cancellations by the Company
These may occur due to force majeure or other circumstances beyond the control of smart holidays®, for which the company shall not be held responsible for any additional costs incurred by the Customer.
12. Check-in / Check-out
- Check-in: 16:00 – 19:00
- Check-out: 09:00 – 11:00
Late check-in (in person):
- until 23:59 → €35
- after 00:00 → €85
The guest is responsible for informing the intended check-out time at least 48 hours in advance.
13. Liability
smart holidays® shall not be held liable for force majeure events or circumstances beyond its control.
14. Keys and Access Cards
Each property provides one set of keys and/or access cards, regardless of its size or type.
Loss, damage, or failure to return the keys or access cards will result in the Customer being charged for any replacement and/or necessary intervention costs.
It is strictly prohibited to duplicate the keys or access cards or to provide them to unauthorised third parties.
15. Personal Belongings
smart holidays® shall not be held responsible for loss, theft, or damage to personal belongings.
16. Customer Support
The support line during the stay is available from 09:00 to 20:00.
17. Complaints
Complaints must be submitted directly to smart holidays® or through the official complaints book, where applicable.
18. Data Protection (GDPR)
Personal data is processed for the purposes of booking management and compliance with legal obligations, in accordance with applicable legislation.
19. Tourist Visa Support Document (Visa Support Letter)
smart holidays® may issue, upon request, a booking confirmation document for visa application purposes.
Conditions:
- booking confirmed and fully paid
- request made by the booking holder
The document includes:
- guest names
- passport numbers
- accommodation location
- check-in and check-out dates
This document:
- does not guarantee visa approval
- does not constitute an official invitation or financial guarantee
smart holidays® reserves the right to refuse issuance in case of suspected misuse.
20. Governing Law and Jurisdiction
Portuguese law shall apply.
For the resolution of disputes, the courts of Portimão shall have jurisdiction, with express waiver of any other.
21. Alternative Dispute Resolution (ADR)
The Customer may resort to official alternative dispute resolution entities.
